<p>前立委馮滬祥被控性侵菲傭案，士林地方法院去年七月時判處他四年徒刑，馮大聲喊冤。至於馮的親友，包括女兒馮復華、馮國華、馮文、女兒友人張蘭石及文大教授陳鵬仁、馮之助理陳蔭華，於出庭時具結卻虛偽證詞，士林地檢署昨日均依偽證罪起訴。 馮滬祥被控性侵菲傭案，去年七月間，士林地院認為菲傭從自身下體九公分深處子宮頸採集的精液，事後加工可能性低，且菲傭在菲律賓的翻供錄影帶，陳述關鍵點明顯與事實不符，不足採信。</p>
<p>當時，法院根據台北榮總醫師鑑定，認為馮滬祥再犯機率低，不需要強制治療。</p>

<p>繼 2003年2月劉俠事件，與今（2006）年九月台中王家一家四口遭菲傭比西塔砍傷事件後，11月14日，又發生越傭阿美砍殺雇主，造成雇主家庭一死一傷的慘劇。居家外勞失控傷害雇主的政策性因素：聘僱外勞雇主的家庭缺乏社福體系的援助、居家外勞又沒有勞動法令保障，勞雇關係成為無法預測的不定時炸彈，問題牽延多年未獲解決，家事服務法推動聯盟今（11/17）召開記者會，邀集內政部及勞委會、職訓局代表，要求給與聘雇外勞雇主「喘息服務」，並儘速制定「家事服務法」。</p>
<p>天主教越南外勞配偶辦公室阮文雄神父與十幾位越南外勞代表，首先為不幸罹難的蔡姓雇主祈禱，希望蔡老太太的在天之靈能夠安息，阮文雄說，他昨天已經去探視過跳樓自殺的阿美，雖然目前沒有生命的危險，但今後勢必癱瘓的她，十分掛念在越南的五歲、六歲的兩個小孩。居家外勞因為生活在雇主家庭，缺乏與同儕交往的機會，發生任何狀況，必須獨自面對；曾經擔任劉俠事件菲傭薇納辯護律師的詹文凱也認為，家庭外傭孤立的狀況，是造成她們處在不穩定、隨時爆發狀況的主因。</p>
<p>而家事服務法聯盟代表龔尤倩在分析三起外傭攻擊事件時，也指出，三起事件顯示出的同質性是，勞僱關係都相當良好，只是爆發突發性攻擊事件的原因，都是外勞在 24小時全年無休的狀況下，產生的情緒不穩，問題直指社福與勞工政策的缺失；陽明大學衛生福利研究所教授王增勇批評，台灣極度「殘補式」的社福政策，放任外勞成為社福的主軸，阿美的事件不是特例，衛生署、社會司必須為政策殺人負起責任；王增勇說，目前政府提供的「喘息服務」，用行政命令的方式，排除已僱用外勞者的適用，這是剝奪僱用外勞家庭享受社會福利的權利。如果居家外勞受到勞動法令保障，則外勞休息時間，形成照顧的空窗，這逼使需受照顧者的家庭，去反對對居家外勞的保障；這種「弱勢者之間相殘」的狀況，王增勇認為，如果不是政府以社福體系支援、介入，根本不可能解決。</p>
<p>事情很明顯，工人的權益被殘破的社福體系絆住了，勞委會、職訓局打蛇隨棍上，當然有繼續拖延外傭適用勞基法，以及把「家事服務法」擱在一邊的藉口，強調必須必須跟內政部的長期照護政策配套，等於直接把球踢回內政部。而代表內政部社會司出席的科長邱月雲說，目前內政部提供的「喘息服務」資源有限，沒有僱用外傭的長期照護者，都不夠用，更何況要照顧到「經濟條件比較好」的有僱用外傭的家庭，邱月雲說，如果這些家庭有喘息服務的需要的話，可以自己去購買；此話一出，立即引起在場者的質疑，有聘僱外傭的需長期照護家庭，是不是就比沒有聘務外傭的家庭有錢，這一點，官方根本提不出任何佐證；更嚴重的問題是，這樣的政策，硬生生把需要長期照護的家庭一分為二，給予差別的待遇，台灣國際勞工協會秘書長顧玉玲質疑，為什麼需要長期照護的家庭，可以因為聘僱了外傭，而失去政府提供的社會福利的權益？同時，所謂補充照顧的目的，是為了怕負擔照顧工作的人壓力過大，那麼，在照顧失能者的本國人與外國人之間，要有如此歧視性的待遇？</p>
<p>王增勇也強烈批判內政部利用行政命令，在弱勢者之間製造矛盾與階層分化的作法，他認為，內政部不斷強調財源有限，那是自我設限，迴避問題的作法，既然是資源不夠，就應該主動編列預算，滿足所有需要長期照護工作家庭喘息服務的需求。出席記者會的立法委員雷倩並要求勞委會、職訓局與內政部兩週內提出改進方案。</p>

<p>繼高雄捷運泰勞以抗暴對非人待遇表達抗議，台北縣兩家科技公司菲勞昨天出面，控訴雇主要求每月加班超過兩百小時，脅迫簽署「沒工作不領錢」協議，甚或連續工作廿四小時，卻被不當扣薪。</p>
<p>對此，勞委會指已請當地勞工局和勞動檢查所在最短時間內入廠調查。台北縣勞工局則說，確曾接獲申訴，但協調後資方請仲介出面安撫，並取得外勞簽字確認，違反勞基法部分尚在調查。 在台灣國際勞工協會的率領下，十八名來自台北縣金協昌科技樹林廠、新莊廠以及宏富科技樹林廠的菲律賓勞工，到行政院前舉牌要求「自由轉換雇主」、「廢除吸血仲介」、「取消外勞在台年限」。</p>
<p><b>被迫負傷上工 沒工作就沒錢</b></p>
<p>金協昌科技的菲勞凱洛琳表示，廠內外勞每天工作超過十六小時，每月加班超過兩百小時，常常連續一個月不放假，加班費每小時僅七十元，雇主還以若沒簽署就遣返為由，脅迫強制大家簽下「沒工作就不能領錢」（No work no pay）協議。</p>
<p>凱洛琳說，外勞一人被當兩人用，薪水還不滿兩萬元，若外勞要中途解約，就會被罰兩個月薪資，職災醫療期間還被迫負傷上工，生病請假還會被倒扣八百元，外勞管理員不但經常以「遣返」加以恐嚇，還常大發雷霆以砸東西、打屁股方式處罰。</p>
<p>宏富科技菲勞多人提出資方所發放的「薪資表」，西莉亞的本薪根本不滿一五八四○元，除勞健保費、預扣繳外，還有水電費、住宿費和便當費超過三千五百元，仲介費用二六二五元，遠超過勞委會規定來台第一年一千八百元上限規定，若因拒絕加班被罰款，所得最低竟僅領不滿四千元。</p>
<p><b>遇上生產淡季 竟被轉賣他處</b></p>
<p>羅絲瑪莉說，生產旺季工廠趕工時，本勞分三班輪班，外勞卻須連續工作廿四小時，甚至有人被迫如機器般卅六小時不休息，管理員還會在半夜進入女工位於工廠樓上宿舍，命令到樓下加班、不得拒絕，生產淡季時被轉賣到新竹、淡水等其他工廠，不但護照、居留證被扣押，每年還扣稅二○％。</p>
<p>勞委會則強調，從未接到金協昌科技勞工傳真陳情案，若有一定會處理，對金協昌和宏富科技案已緊急請台北縣勞工局針對勞動條件確認，同時北區勞動檢查所也將會同入廠檢查，若有違法一定開罰。</p>
<p><b>遭控訴兩公司拒回應</b></p>
<p>被外勞向行政院勞委會告狀的台北縣樹林市金協昌與宏富二家公司，昨天面對記者查證，態度同樣推託。金協昌更在記者第二度詢問時，直接掛電話。宏富則始終推稱長官還在開會，兩家公司都不肯正面回答問題。</p>
<p>不過據了解，公司方面已得知菲勞的舉動，且頗感意外，他們自認對員工很照顧，不分本國外籍，但這幾名菲勞沒請假也沒簽出，其中二人還藉口去看病。據悉，兩家公司菲勞結伴主因，是同屬一個教會所致。</p>

<p>外勞政策扭曲，最鮮明的例子是申請外籍監護工標準「巴氏量表」過於嚴苛，家有重症、老人無法申請「幫手」、坐困愁城，有辦法者鑽巧門或透過造假診斷書違法申請；另方面，現行法令規定外勞工作年限、不得轉換雇主，造成「外勞才熟練照顧病患、與照料老人產生親人般感情與信任，就準備打包遣送回國」奇怪現象。</p>
<p>「總統夫人吳淑珍不能行動，居然不符申請外籍監護工條件」，巴氏量表有多嚴苛，以進食來說，儘管已患重症、不良於行，如自己可在合理的時間內（約十秒鐘吃一口）用筷子取食眼前的食物」評為10分，需要別人幫忙穿脫輔具或只會用湯匙進食5分，無法自行取食或耗費時間過長者0分；可獨立完成輪椅的煞車及移開腳踏板15分，需要稍微的協助（例如：予以輕扶以保持平衡）或需要口頭指導 10分，可自行從床上坐起來，但移位時仍需別人幫忙者5分，需別人幫忙方可坐起來或需別人幫忙方可移位0分；可獨立完成洗臉、洗手、刷牙及梳頭髮5分，需要別人幫忙者０分，總計十個項目總分在30分以上，就不能申請外勞。</p>
<p>這麼嚴苛的標準，是在外勞總量管制下，家庭外勞與製造、營造業外勞競合的不合理結果，事實上，國內需要照護的人口至少15萬人，現有家庭類外勞根本不敷所需，中下雙薪家庭又亟須照護人力，也因而衍生「巴氏量表造假」現象。</p>
<p>由於國內人口結構逐漸步入老年社會，中風等重症慢性病患者增加，政府於81年開放引進外籍監護工及家庭幫佣，規定「二加一」，雇用兩年期滿可再申請延長一年，稍早放寬為「三加三」，工作年滿三年應出境再入境工作三年，且限制外勞不能自由轉換雇主。</p>
<p>「政府未建制完備社福照顧體系、規劃錯誤的外籍監護工、家庭幫佣政策，造成家有老弱病殘家庭困擾、外勞遭剝削、受虐及逃跑事件層出不窮」，國際勞工協會秘書長顧玉玲痛批，高雄捷運泰勞抗暴事件只是冰山一角，更嚴重的，是外勞總量管制下，不適用勞基法的家庭類外勞成為法外孤兒，勞動條件未獲保障、全年無休、求助無門，家有老人、重症雇主也擔心外勞成為「不定時炸彈」。</p>
<p>顧玉玲指出，工作年限及不得自由轉換雇主雙重限制，及外勞沒有家事服務法保障普遍被當「7-11」全年無休情形下，造成諸多後遺症，就雇主來說，中下家庭沒有替代人手，實例中出現不少外勞因在封閉工作環境下全年、24小時無休神經耗弱，照顧國策顧問劉俠不當致死的印勞羅斯，就是最典型例子。</p>

<p>高雄捷運爆發泰勞反抗不人性管理事件，國際勞工協會、人權組織及工會團體昨天前往勞委會聲援泰勞，要求勞委會追究失職行政官員責任，取消私人仲介制制，推動仲介公營化，並呼籲曾為政治犯的勞委會主委陳菊正視外勞勞動人權，不得秋後算帳遣返外勞，確保抗暴外勞工作權。</p>
<p>勞工團體昨天動員約50人，高舉「反奴役」、「抗暴有理」標語布條，前往勞委會聲援泰勞，要求會見陳菊未果，與警察發生推擠，現場混亂。</p>
<p>國際勞工協會理事長陳素春指出，高雄捷運抗爭事件禍首不是放火滋事的外勞，而是長期高壓「奴工式」管理及剝削的雇主、管理公司，事實上，早在一年前，外勞就提出申訴，但未獲回應及改善，主管「官僚」及不人道雇主應負最大責任，勞工團體呼籲，勞委會應確保外勞工作權，不得以任何理由將之遣返。</p>
<p>合法仲介業者昨天召開記者會，指勞委會推動外勞「國對國直接聘僱」政策立意雖好，但執行有漏洞，由非專業的管理公司管理，是高雄捷運發生問題主因，呼籲政府立即取消直接聘僱，否則難保事件不會再度發生。</p>

<p>Thai workers clear debris from a riot in Kaohsiung yesterday. More than 1,700 Thai workers set fire to a management shack, burnt cars and hurled rocks at police after their employers refused to allow them to drink, smoke and use cellphones when they were off work, police said yesterday. The violence erupted late on Sunday among the workers, hired to help build a mass-transit railway project in Kaohsiung.</p>

Furious with what they saw as inhuman personnel management, some 300 Thai workers in Kaohsiung set fire at the management center, a work dormitory, cars and other facilities Sunday night, police said.</p>
<p>Television stations aired footage of the workers clashing with police, attacking them with rocks and bottles in the overnight riot.</p>
<p>Several officers were injured by rocks shot with slings by the Thai workers, while one Thai worker was injured by broken glass in the dormitory, police said.</p>
<p>The riot began about 9:30pm Sunday at the five-story dormitory housing 1,700 Thai workers, who are building the Kaohsiung mass-transit system. The management company was hired by the Kaohsiung Mass Transit Bureau to manage the workers&#8217; living conditions.</p>
<p>&#8220;Some Thai workers clashed with management personnel, who tried to discipline the drunken workers who were shouting in the dorm. The management personnel stopped one Thai worker from using a cellphone and reportedly hit him with an electric prod,&#8221; the Broadcasting Corporation of China (BCC) reported.</p>
<p>Thai workers living in cramped conditions in dormitories. The lack of basic freedoms led to a riot yesterday at worker dormitories in Kaohsiung.<br />

&#8220;The two incidents prompted the Thai workers to vent their pent-up anger at the management, so they rioted,&#8221; it reported.</p>
<p>In addition to the bans on alcohol, cellphones and Thai television in the dormitory, the Thai workers were required to use tokens in the dorm store, but they allege they were short-changed when exchanging the script for real money, it added.</p>
<p>Of the 1,700 Thai workers in the five-story dorm, some 300 took part in the riot, setting fire to management offices and cars, burning clothes and hurling rocks at police who responded to the fire report.</p>
<p>Police, members of Thailand&#8217;s representative office in Taipei, the construction company and the recruiting firms&#8217; representatives were involved in negotiations with the Thai workers to end the standoff.</p>
<p>Authorities yesterday agreed to the demands made by several hundred Thai workers, ending the confrontation.</p>
<p>But officials also decided to charge the rioters and deport them for starting the riot, which cost the employer at least NT$10 million (US$322,500) in damages.</p>
<p>&#8220;After three rounds of talks, the Thai workers have agreed to end their protest and return to work after the management company accepted most of their demands,&#8221; said Fang Lai-chin (方來進), the director of the labor bureau of the Kaohsiung City Government.</p>
<p>The workers demanded that they be allowed to use cellphones, that food quality at the cafeterias be improved and that a satellite dish be installed so they can watch TV programs from their home country.</p>
<p>They also protested the management company&#8217;s unreasonable methods of payment &#8212; for each 100 hours of overtime, they are only paid for 46 hours.</p>
<p>The workers also complained that they could not take back food and daily necessities that were not purchased at the dormitory store.</p>
<p>The Huapan Co last afternoon agreed to most of the workers&#8217; demands.</p>
<p>Fang said the labor authorities will investigate the management methods of the company and will ask that the company dismiss supervisors treating the workers in inhuman ways.</p>
<p>Meanwhile, officials threatened the workers who took a stand against the company with deportation. Lai Chin-lin (賴勁麟), vice chairman of Cabinet&#8217;s Council of Labor Affairs, said workers found guilty of starting the riot will be deported for violating law and order.</p>
<p>He said the council will also punish the employer, the Kaohsiung Mass Transit Bureau, for mismanagement by slashing by 800 the number of foreign workers the company is entitled to import to help it construct the transit system.</p>
<p>Asked for comments, Premier Frank Hsieh (謝長廷) said yesterday that local employers must try their best to protect foreign laborers&#8217; legal and human rights.</p>
<p>&#8220;These people [foreign workers] flew far away from their homes and came to Taiwan for jobs, and most of them are doing heavy-duty work, such as construction work. Basically, we should try to understand their feelings,&#8221; the premier said.</p>
<p>&#8220;Employers should pay attention to these foreign workers&#8217; emotions from time to time, because it will be too late to do so when tragedy happens,&#8221; he said, adding that he has already directed the Council of Labor Affairs (CLA) to look into the latest incident.</p>
<p>There are some 100,000 Thai workers in Taiwan.</p>

<p>More than 100 Thai workers burned down a building and clashed with riot police early yesterday morning outside their cramped Kaohsiung dormitory to protest their treatment at the hands of a management consulting company hired by the Kaohsiung Rapid Transit Corporation.</p>

<p>The workers calmed down, however, at around 1 a.m. yesterday morning after 470 riot police were brought in, and the crisis was further defused yesterday afternoon when the management company agreed to 14 of the 16 demands made by the migrant laborers during the protests.</p>
<p>The riot erupted Sunday night near a construction site for the Kaohsiung MRT system in Kangshan where the protesting Thais work. Tempers flared after the building&#8217;s security personnel barred three Thai workers from bringing cigarettes and liquor into the dormitory.</p>
<p>Thai workers told the Central News Agency they were then beaten for the disruption, the last straw in their mounting discontent over the management company&#8217;s strict work and living rules and unfair treatment.</p>
<p>More than 100 Thai laborers joined their angry colleagues in burning down the management office and setting fire to four cars, while slinging stones at police and firemen on the scene. The clashes left behind an estimated NT$10 million in damage.</p>
<p>The rioters &#8220;threw stones at us, trying to stop us from putting out the fire,&#8221; an unnamed firefighter told a television station.</p>
<p>Several workers and police were slightly injured, a police officer said.</p>
<p>The company charged with managing the subway project&#8217;s 1,728 Thai workers, Hua Pan Administration Consultant Co. Ltd., won the job through a KRTC tender, but resentment has been growing over the company&#8217;s perceived injustices.</p>
<p>KRTC official Liu Ke-chiang said yesterday that the protesters confessed that a riot had been planned for some time because of the mounting dissatisfaction, including charges that some of the supervisors frequently beat the Thai workers.</p>
<p>Worker representatives asked the KRTC to replace their supervisors or send the workers home.</p>
<p>While the KRTC apparently denied the request, Liu indicated managers would be dismissed if an investigation into their behavior found they had treated the Thai workers inappropriately.</p>
<p>After nearly 12 hours of negotiations, the management company and KRTC did agree to some of the worker demands, including: improving the workers&#8217; living conditions; allowing them to use cell phones and have alcoholic beverages in the dorm; paying the workers for the actual number of overtime hours worked; not forcing them to work on holidays; and not using violence to discipline them.</p>
<p>Also at the meeting were officials from Thailand&#8217;s representative office, the local police precinct and the District Prosecutors Office.</p>

The workers earlier indicated that they often put in 100 hours of overtime every week but were only paid for 46 hours of work.</p>
<p>In addition, many workers contended it was unreasonable for their Taiwanese supervisors to prevent them from taking food and daily commodities to the dorm, forcing them instead to buy these necessities at the company canteen using substitute currency provided by Hua Pan.</p>
<p>Some workers charged that they only received NT$0.80 to NT$0.85 in substitute money for every Taiwan dollar they earned in income.</p>
<p>The company also installed electronic gambling machines in the dorm that also would only accept the substitute currency.</p>
<p>While the majority of the 1,728 workers in the dorm are likely to hold on to their jobs, the police vowed that those who led the clashes or violated the law would be repatriated to Thailand, a promise backed up by the Council of Labor Affairs (?quot;委會).</p>
<p>Bureau of Employment and Vocational Training Director General Kuo Fong-yu (郭芳?) added that to prevent foreign workers from jeopardizing public security, they would be prohibited from returning to Taiwan to work if they broke the law here.</p>
<p>Kuo also indicated that the bureau would suspend plans to bring in an additional 900 foreign workers requested by the KRTC to complete the project.</p>
<p>Meanwhile, the CLA announced yesterday it would step up its supervision of enterprises hiring 100 or more foreign workers to ensure that scenes like the one in Kaohsiung Sunday night are not repeated.</p>
<p>CLA deputy chief Lai Chin-lin (賴勁麟) said the riot not only affected social order but also damaged Taiwan&#8217;s global image.</p>
<p>He said the CLA will invite scholars, experts, officials from the Thai representative office in Taiwan, and representatives from human rights groups to form a task force to investigate the case.</p>
<p>Lai also said that in order to prevent similar incidents from happening again, the CLA will set up a special team to make unannounced checks on companies that employ more than 100 foreign laborers to make sure their living conditions, including food, lodging and other care provided by the management, comply with CLA regulations.</p>
<p>According to statistics compiled by the CLA, there are about 700 companies in Taiwan that employ 100 or more foreign workers.</p>
<p>Thailand has the largest contingent of foreign workers in Taiwan with 94,742, followed closely by workers from the Philippines (85,024) and Vietnam (82,491).</p>

<p>高雄捷運工地爆發國內有史以來最大規模外勞暴動，外勞團體痛批，部分仲介採軍事化管理，動輒扣款懲罰，有人一天被扣兩千元，有人被罰站，住宿環境髒亂又擁擠，猶如豢養動物，根本是美國黑奴制度在台重生。仲介業者也坦承，嚴格管理加上高額扣款當懲罰，常成為衝突發生來源。</p>
<p>對於扣款懲罰，勞委會職訓局長郭芳煜說，若勞資雙方訂有工作契約，勞委會不便置喙，但以扣款作為懲罰外勞的手段，確實不合情理也不應該，勞委會將加強查察。</p>
<p><b>違規就扣薪 牆角罰站</b></p>
<p>「台灣國際勞工協會」理事長陳素香表示，仲介對營建外勞多採集中管理，普遍過於嚴苛，因為業主全權委託仲介負責，管理人員掌握生殺大權，作威作福，對外勞動輒威嚇叫罵。</p>
<p>所謂嚴苛規定，陳素香說，包括遲到、早退等違反工作規定就扣薪水，宿舍晚上十點關門，遲歸也扣薪。曾有外勞跟她說，一天被東扣西扣高達兩千元，有工地傳出違反規定就體罰，通通叫到牆邊去罰站，威權式管理將外勞當小學生管。</p>
<p>陳素香說，本國勞工到外地工作可以選擇住在工廠或另租屋，外勞卻被強制住在「宿舍」，住宿環境令人不敢領教；空間狹小悶熱又擁擠，又是鐵皮屋，以台灣夏季炎熱，更令人難以忍受，根本就是「新奴隸制度」，將外勞當成奴隸般關在籠內，不乖就管教。</p>
<p><b>計薪剝權利 積怨爆發</b></p>
<p>另一常發生的問題是薪資計算，陳素香說，部分雇主未確實計算加班時數，或計算方法和原先所說不同，外勞權利被剝奪卻有苦無處訴，加上沒有工會組織可以反應或宣洩，爭取自己權益，積怨太久當然會爆發。</p>
<p>「勞動人權協會」昨晚也發表嚴正聲明，指控問題的發生主要是身為這批外勞雇主的高雄捷運公司，放任外勞管理公司華磐採取嚴苛僵硬又違反人權的生活管理方式，要求泰勞每月超時加班也明顯違法。</p>
<p>勞權會表示，工地所在地主要在高雄市境內（高雄捷運橫跨高雄縣市），但勞工生活圈卻集中在高雄縣境內，縣市勞工主管單位在勞動檢查都有嚴重疏失。</p>
<p>陳素香認為，若勞動檢查單位進行勞動檢查時，介入了解居住環境以及管理措施，昨天的暴動絕不會發生。他們要求仲介管理應更人性化，對出面爭取權益的外勞更不應遣送出境，他們只是爭取應有的勞動權益。</p>

<p>高雄捷運公司的「外勞」抗爭事件，媒體多以「暴動」稱之。而輿論與政府相關單位的關切，似也集中在「是否繼續引進外勞」、「將帶頭者遣送出境」等表象，儼 然把這群外勞當作「問題製造者」。但若對這些被稱為「外勞」的移工在台的處境稍有了解，就會赫然發現他們的生活與工作條件，早已違背了文明國家的最低人權 標準。稱之為國際法上的「強制勞動」（forced labor）甚或「奴役」（servitude），絕不為過。如果不改善這些非人化處境，那麼外勞的激烈抗爭，就像從前美國黑奴層出不窮的流血抗暴事件一 樣正當，絕不能單以「非法暴動」視之。</p>
<p>舉例而言，「防止人口販運公約」、「禁止奴隸公約」、「禁止強制勞動公約」以及「移工與家庭成員權利公約」（簡稱「移工公約」）等重要的國際規範，均明文 禁止「強制勞動」，並將強制勞動等同於奴隸制度。且「強制勞動」並不限於直接的暴力壓迫，也包括身體或行動自由的限制與威脅，以及濫用法律程序施壓。台灣 雇主對移工常用的「扣留」（或稱「保管」）護照、扣押工資、限制行動自由，以及動輒恐嚇「遣返回國」，在前述公約與國際實務來看，都已構成非法的「強 制」，而使得身處外地的移工處於「奴役狀態」。尤有甚者，對照美國國務院在2005年發布的人口販運報告，由於有著前述的慣行，台灣的雇主甚至是整套外勞 法制，都有構成「販賣人口」而遭制裁之虞。</p>
<p>勞動基準法第五條雖有禁止強制勞動的規定，就業服務法也禁止雇主非法扣留護照，但實務上仍層出不窮。本案中外勞的護照被付之一炬，顯然也有「代為保管」的 措施。這顯示我國實務對「強制」、「非法」的解釋與執法態度，大有問題。至少「保護不足」，等於放任雇主以各種手段奴役移工，同樣在人權標準上站不住腳。 而且這些基本權利，是不能以「契約自由」來加以限制的。即便勞工在形式上「同意」，雇主的行為仍然可能構成「非法強制」。</p>
<p>此外，我國容許雇主對外勞「僅需支付基本工資」，牴觸了「移工公約」第廿五條以及「外國人權利宣言」有關「與本國人同工同酬」之要求；雇主既控制移工的居住行動自由，又不為他們裝設可收訊母國節目的電視設施，亦有拒絕移工公約第十三條「跨疆界收訊自由」之虞。</p>
<p>或許會有人認為：外勞權益受損，可循合法管道尋求救濟。但現實是：爭權益的外勞，往往在爭議尚未處理結束，是非未明之前，就被警方甚或仲介遣返回國。即便 有幸留下來硬撐過司法途徑，在語言及各方面資源欠缺的情況下，憲法上的訴訟權也難以提供有效保護。國際公約多要求國內司法制度應提供外國人適用之語言，同 時在移工提出申辯與審查之前不得執行遣返處分，但我國的移民法制完全沒有顧及這些人權法上的基本要求。</p>
<p>一向只把人權當嘴皮武器用的政府機關，或許不會將人權公約放在眼中。但保障移工最起碼的基本權利，已成為國際趨勢。國際移工跨海而來，為「咱台灣人」的建 設貢獻心力，承受剝削，乃至在職場災害中粉身碎骨。然而，我們回報的是什麼？不公平的勞動條件、薪資被扣無法自由使用、行動不自由還經常受不法或欺騙式的 威脅、護照被扣留，而且沒有任何正當管道可提供有效救濟…試問如果這樣的待遇發生在你我身上，要不要反抗？</p>

<p>外勞管理又出狀況，仲介業者、勞工團體都認為，主因在於業者沒將「外勞」當成自家人，缺乏人性化管理。外勞長久沒有適度的宣洩管道，一發就難以收拾。</p>
<p>政大勞研所教授成之約指出，工地外勞經常工作超時，加上居住空間狹窄，娛樂少，生活苦悶，必須要有更多的輔導，目前政府規定企業要有生活管理計畫書，但執 行查核時卻有不少困難，如生活管理人員數目雖規定與外勞的比例必須是五十比一，但生活管理人員很難界定，許多地方都是由翻譯人員充任，但這些人員能做到多 少心理與生活的輔導，令人懷疑。</p>
<p>國際勞協秘書長顧玉玲說，捷運泰勞抗爭中，高雄捷運公司及華磐公司不約而同說要將「帶頭鬧事者遣返」，外勞應不受遣返威脅，否則剝削外勞工作權的耳光，已甩在號稱人權立國的台灣政府的顏面上。</p>
<p>從事外勞管理多年的大智仲介董事長張添勇說，高雄捷運出事工地採取軍事化管理，很難不出問題。外勞必須備有人性管理制度及輔導，包括：提供該國報章雜誌、 電視、卡拉OK、桌球等；配合外勞的宗教信仰安排宗教活動；建立勞資雙方溝通及糾紛事件協調處理，提供專人翻譯及代筆家書等，否則情緒難以疏導。</p>
